Tennessee Sen. Lamar Alexander released a statement this morning saying the Senate-approved health care bill is riddled with “sweetheart deals” that will increase taxes and damage education.

Fellow Republican, Sen. Bob Corker, said the bill is “fundamentally flawed” and called for bipartisanship.

The bill, approved on a 60-39 vote, must still be merged with legislation passed by the House.

“The Senate health bill will prove to be an historic mistake if this or anything like it is ultimately signed by the president,” said Alexander, who is chairman of the Senate Republican Conference.

“Congress set out to reduce health care costs to Americans and Democrats have managed to do the exact opposite. Their written-in-secret bill will increase health insurance premiums, raise taxes, cut Medicare and dump millions of Americans into Medicaid.

“For Tennessee, Medicaid’s expansion and the bill’s ‘sweetheart deals’ would cost our state more than $750 million over five years when fully implemented, forcing tax increases or damaging higher education—or both.

“Instead, we should start over and move step-by-step to reduce health care costs using the steps that Republicans have repeatedly proposed: let small businesses pool resources for health insurance; allow purchasing of health insurance across state lines; end junk lawsuits against doctors; eliminate waste, fraud, and abuse; expand health savings accounts; and promote wellness and prevention. ”

Corker said in his statement, “I’ve spent almost three years and countless hours in bipartisan meetings working toward reforms that would enable all Americans to access affordable, private health insurance.

“I wanted a bipartisan health care reform bill that would stand the test of time. Instead, we were forced to vote on a 2,000-plus page, fundamentally flawed, partisan bill that expands Medicaid by sending $25 billion in unfunded mandates to states, takes $464 billion away from Medicare and leverages it to create a new entitlement, uses budget gimmickry to hide its true cost; increases federal costs, and actually causes Americans to face increased taxes and premiums.

“It’s my sincere hope that Congress returns in 2010 more willing to work in a bipartisan fashion, and my work on financial regulatory reform gives me hope that that’s possible. ”

Scott P. Brown’s win yesterday may be a harbinger of things to come for Obama’s health care reform plan; the idea of universal health insurance first touted in Obama’s platform for change seems to be on the verge of severe change itself. One question Republicans will likely concentrate on at present is whether mandatory private insurance violates the constitution or not.

The shock of a Republican winner in Massachusetts, a traditionally very, blue, very Democratic state is just beginning to be felt. One thing, however, is sure – voters are angry. The Obama administration’s focus on passing health care reform to make affordable health insurance more accessible to masses seems to have caused ire in his constituency. With the effects of the recession still on everyone’s mind, the concentration on health care has hampered Obama’s plans. Now Republicans have the power to impede those exact plans.

Republicans have plenty to discuss. Many Republicans have seen the health care plan from the get-go as a travesty to local governments. The legislation entitled “The Enumerated Powers Act”, has brought with it a large amount of discussion, however not much action.

Senator Obama has many challenges ahead. The Republican win last night indicates that people want a change. The question of the constitutionality of mandatory private health insurance looms. Republican Scott Brown, fresh off his victory in the Massachusetts race for U. S. Senate, called on the secretary of state to send him to Washington immediately, saying Wednesday that he wants to send health insurance reform “back to the drawing board. ”

Though the state typically waits at least 10 days to collect absentee ballots before certifying, the senator-elect said he’s “confident” his margin of victory — 5 points and nearly 110,000 votes — was greater than the number of outstanding ballots.

Brown is champing at the bit to be sworn in since he would become the 41st Republican in the Senate, breaking the Democrats’ 60-vote supermajority and potentially scuttling health care reform if it returns to the chamber for a final vote.

“Since the election is not in doubt, I’m hopeful that the Senate will seat me on the basis of those unofficial returns,” Brown said, adding that he’s already spoken to members of the state’s congressional delegation, including Sen. John Kerry, and will travel to Washington Thursday. “I think it’s important that we hit the ground running because there’s some very important issues facing our country. ”

On health care reform, he said he wants “everyone” to have some form of health care coverage, but questioned plans to slash Medicare and raise taxes to do it.

“I think we can do it better,” he said.

The Republican senator-elect said he was focused on moving to Washington as soon as possible to try to free up some of the political gridlock there.

“I have always just wanted to go down and solve the problem regardless of party,” Brown told NBC’s “Today” Show.

“While they’re in Washington talking about what someone said in a book and what this happened, we have some very serious problems when it comes to over-taxation, overspending and Al Qaeda who are trying to kill us. So we need to get back to the basics and start solving problems that affect every person in this country,” he said.

Brown’s insurgent candidacy has forced Democrats to rethink the basics on several matters, including the massive health insurance reform bill that is tagged to cost nearly $1 trillion over 10 years. They are also reconsidering agenda items they plan to use in November’s midterm election campaigns.

By winning the Senate seat in Massachusetts by nearly the same margin that President Obama defeated Sen. John McCain in November 2008, Brown takes away Democrats’ filibuster-proof majority and can pull a reverse-Obama — claiming a mandate to defeat the health care legislation now stuck in Congress.

Despite the upset, Obama adviser David Axelrod said administration officials will take into account the message voters delivered Tuesday but declined to go further.

“It’s not an option simply to walk away from a problem that’s only going to get worse,” Axelrod said of the health care bill.

Sen. Susan Collins, R-Maine, said one of the many messages coming out of the Massachusetts election is that Americans are sick of partisan gridlock, but voters also had a much more expansive recommendation.

“They want better performance out of Washington, they want us focusing on the troubled economy and the need for more jobs and . . . they’re tired of sweetheart deals that were sneaked into the health care bill. They want that kind of bill to be negotiated in the open. And they’re tired of politics as usual and they also want controls. They don’t want unfettered, one-party control,” Collins told Fox News.

Collins said she cannot support a bill “that imposes billions of dollars for new taxes, slashes Medicare by $500 billion and would actually cause insurance rates to go up. ”

“We really should start from scratch and do a completely bipartisan bill,” she added

But Pennsylvania Gov. Ed Rendell said that Americans oppose the health insurance changes because “the administration and its supporters, myself included, haven’t done a good enough job explaining to people what’s in this bill. ”

Rendell said he wants to go back to the drawing board in order to better communicate the message. If that fails, and a filibuster is threatened, then Democrats shouldn’t “just cave” but should make the other side “explain why they’re trying to block the bill with this type of political chicanery. ”

“I haven’t heard one good alternative offered by any Republican except let’s start at the beginning, let’s start all over. Start all over to do what?” he asked.

Rendell added that he wants to call the GOP’s bluff.

“Let them filibuster, let them take to the floor and speak endlessly and endlessly about why this is bad for the American people and what the alternative is,” he said.

As the debate continues over whether to scrap the year-long health insurance reform effort, some are also looking at whether Republicans can repeat the feat in Massachusetts in other states.

Seven Senate seats now held by Democrats are now considered toss-ups in November — Nevada, Colorado, Arkansas, Illinois, Pennsylvania, Delaware and Connecticut. Four Republican seats are in the same situation — Missouri, Kentucky, Ohio and New Hampshire.

“I think anybody who’s up for election this November ought to take seriously what the people of Massachusetts had to say in that special Senate election,” said Sen. Joe Lieberman. D-Conn.
Sen. John Cornyn, R-Texas, head of the National Republican Senatorial Committee, said Democrats nationwide should be on notice

“Americans are ready to hold the party in power accountable for their irresponsible spending and out-of-touch agenda. ”

But Democratic Senatorial Campaign Committee Chairman Robert Menendez cautioned against “taking a single unique election and extrapolating what it means for the midterms 10 months away. ”

Still, Menendez said he doesn’t want to sugarcoat what happened and Democrats will be sorting through the lessons in the days ahead.

Republican state senators called on California Attorney General Jerry Brown Tuesday to join other states and sue the federal government over health care reform.

The legislators said Congress cannot force people to buy health insurance or any other products.

Attorneys general in 13 other states have already filed suit against the health care overhaul that President Barack Obama signed into law. The bill will require most Americans to carry health insurance.

“I think that many Californians share the same view that this is the greatest expansion of government in a generation,” said Senate Minority Leader Dennis Hollingsworth, R-Murrieta.

State Sen. Tom Harman, R-Huntington Beach, sent the letter to Brown.

“The federal government is limited in what it can and can’t do by the Constitution,” Harman said, calling the measure a violation of the commerce clause.

Brown issued a statement saying he had instructed his deputies to review the claims made by the senators.

However, Brown, a Democrat and former two-term governor, noted that all but one of the 13 attorneys general who vowed legal action were Republicans.

“Health care is not the place, with people’s lives at stake, to engage in poisonous partisanship,” Brown said in the statement.

Republicans seeking their party’s nomination for governor, Steve Poizner and Meg Whitman, opposed the health care package and supported a state lawsuit.

Poizner, the state insurance commissioner, said consumers could face higher health insurance premiums and an onerous mandate to get health insurance whether they want it or not.

Whitman campaign spokeswoman Sarah Pompei called the health care plan a “new, big government program. “

The Republican lawmakers also decried what they called an unfunded mandate, estimating the plan would cost California taxpayers $3 billion.

Sen. Tony Strickland, R-Thousand Oaks, said voters should have final approval over the measure.

“It’s clear to me that people’s voices are not being heard in Washington, D. C. , or in Sacramento,” Strickland said. “At a time when we a have high unemployment rate, this is going to be devastating to our California economy. “

The California Democratic Party said the health care overhaul will provide insurance coverage to 7. 3 million Californians who do not currently have it and give a tax credit to some 390,000 small businesses in the state.

This Week in Health Care Reform     

Health care reform legislation passed the House this week on a party-line vote. Late Sunday night, House Democrats approved the Senate health care reform package, sending the legislation to President Obama for his signature. On Tuesday, President Obama signed the underlying bill into law, yet the House has yet to finalize the package of “fixes” that will alter the final implications of the legislation.

Health Care Reform Negotiations

House Democrats Pass Health Care Reform Package: The House of Representatives approved the Senate health care reform bill Sunday night by a vote of 219 to 212. The vote marks the climactic finale to a year-long debate over health care reform. In the final vote, 34 Democrats joined all House Republicans in voting against the measure. Shortly thereafter, the House also passed a package of “fixes,” by a vote of 220-211, that was sent directly to the Senate for its approval through reconciliation. On Tuesday, President Obama signed into law the Senate health care reform bill, called the “Patient Protection and Affordable Care Act. “

Republicans Force Senate to Send the Reconciliation Bill Back to the House: Shortly after the President signed the Senate bill into law, Senators began deliberations on the reconciliation bill. Reconciliation protocol restricts Senators to 20 hours of debate on the measure, but it does not limit the number of amendments that can be filed. In an expression of opposition to the bill, Republicans filed 29 amendments to the reconciliation package.

After 10 hours of continuous debate, Republicans were successful in eliminating two provisions related to college financial aid in the non-health care portion of the bill. The Senate parliamentarian ruled early Thursday morning that those two provisions violated the chamber’s rules, sending the legislation back to the House for a new vote. As a result, on Thursday afternoon, the Senate voted on the reconciliation bill without those two provisions and sent the bill  back to the House for a vote on final passage. The House vote will likely come Thursday evening.

What Does This Health Care Reform Legislation Mean: While the health care reform bill extends insurance coverage to 32 million more Americans by 2019, the legislation has other far-reaching implications that will be phased in sooner, during a multi-year implementation period.

Several features of the new health care overhaul bill that would take effect in 2010 under the measure passed Sunday include:

* New product requirements beginning 6 months after enactment, including:
o Coverage for dependents up to age 26
o No lifetime maximum benefit limits
o And no cost sharing on preventive care for certain policyholders
* Temporary federal high risk pools;
* Tax credits for small employers; and
* Prohibition on pre-existing condition exclusions for children (beginning 6 months after enactment).

Most Americans will have until 2014 to purchase insurance or pay a penalty. Other elements of the bill that will not take effect until at least 2014 include insurance marketplaces called “exchanges”; rules requiring insurers to accept all applicants regardless of pre-existing conditions, and an expansion of state Medicaid programs.

A number of experts question whether health care reform will really drive down insurance premiums. America’s Health Insurance Plans ( AHIP), the trade group representing health insurers, outlines a series of concerns related to the legislation including a lack of provisions that address underlying health care costs, improve quality of care or ensure a stable risk pool. In addition, AHIP expressed concerns regarding new taxes on health coverage, which will likely increase premiums.

Additional Activities

Obama’s Executive Order on Abortion Funding: On Sunday afternoon, prior to the final House vote on health care reform, President Obama agreed to issue an Executive Order that would uphold the ban on federal funding for abortion . In so doing, he secured about a half-dozen votes from anti-abortion Democrats, led by Rep. Bart Stupak (D-MI), who previously opposed the legislation. On Wednesday, President Obama signed the Executive Order banning the government from spending federal money to pay for abortions through plans offered on the insurance exchanges created under the measure.

States Filing Lawsuit to Fight Provision of Health Care Reform Bill: In response to the new health care reform legislation, states across the country have filed lawsuits asking the courts to declare the law unconstitutional and to bar its enforcement. On Monday,Attorneys General in 13 states, led by Florida, filed a joint lawsuit claiming that the new health care reforms violate state government rights in the U. S. Constitution and will force massive new spending on hard-pressed state governments. Joining Florida in the suit are Alabama, Colorado, Idaho, Louisiana, Michigan, Nebraska, Pennsylvania, South Carolina, South Dakota, Texas, Utah and Washington.

At the same time, the Attorney General in Virginia filed a separate suit contending that Congress has exceeded its power in mandating that people buy health insurance. Virginia Attorney General Ken Cuccinelli argues that the new law’s requirement clashes with Virginia law that exempts citizens from federal fines imposed for not having health insurance.

Senate Voting to Extend COBRA Until May 5:  Senate Democrats plan another short-term extension of unemployment aid this week, setting up a face-off with Republicans, who are vowing to fight the extension if the $10 billion cost isn’t offset with spending cuts. The bill, currently set to expire on April 5, would extend a series of emergency programs – including funding for unemployment insurance benefits and COBRA health coverage for the jobless  – and would hold off a deep cut in reimbursement rates for doctors who serve Medicare patients. The long-term extension has already passed in both the House and Senate, but the two measures are not expected to be reconciled and sent to the President’s desk until after the Easter recess.

President Obama Heads to Iowa to Speak on Health Care: President Obama headed to Iowa on Thursday to increase support for his health care legislation. This was President Obama’sfirst trip out ofWashington since signing health care reform legislation earlier this week. He spoke at the University of Iowa, in the city where he first announced his health care proposal during the Presidential campaign.

Public Opinion

Most Americans Want Republicans to Fight Health Care Reform Bill: In a recent CBS News poll, 62 percent of Americans said they want congressional Republicans to continue challenging the bill, while 33 percent said they should not. Disapproval of the bill has remained steady, with 46 percent saying they disapprove, including 32 percent who “strongly” disapprove. A majority of Americans continue to say that they find the bill to be confusing and do not understand what it means for them or their family.

American’s Split on Health Care Reform Passage: In a recent USA Today/Gallup poll, 42 percent of Americans said they were angry or disappointed with the recent passage of health care reform legislation. When asked to reveal party affiliation, 79 percent identified themselves as Republicans.

Polling Shows Support for State Lawsuits Against Government: National polling reveals significant opposition to the individual mandate. In a newly released Rasmussen report , 53 percent of those polled oppose the new mandate requiring every American to buy or obtain health insurance. Further, 49 percent of voters are in favor of their state suing the federal government to fight the mandate. Fifty-one percent say individual states should have the right to opt out of the health care plan entirely.

Looking Ahead

After this week’s final health care reform vote, President Obama plans to travel the country in the next few months to discuss the new law. Republicans have begun their own discussions of the law, with an eye towards the November elections.
